      <title>Hospital Settles Cerebral Case for $14 Million</title>
      <description>&lt;p&gt;A hospital has settled a medical malpractice suit with the family of a young boy for $14 Million last week.  The 5-year-old boy suffered a &lt;a href="http://www.chicagotribune.com/news/local/chi-nulawsuitmay31,1,3603516.story?coll=chi-news-hed"&gt;birth injury&lt;/a&gt; that led to cerebral palsy.  The hospital staff did not administer treatment in time to prevent his injuries.&lt;/p&gt;&lt;p&gt;&lt;blockquote&gt;The malpractice complaint against Northwestern Memorial Hospital contended the baby was not breathing when he was born and that emergency staffers were not prepared to resuscitate him because of the monitoring error.&lt;/p&gt;&lt;p&gt;The 7-minute lapse without oxygen caused the child to suffer from cerebral palsy, leaving his arms and legs paralyzed, according to the complaint.&lt;/blockquote&gt;&lt;/p&gt;&lt;p&gt;The boy was born on May 24, 2002 and can not walk or talk.       <title>Birth Injuries And Language Barriers</title>
      <description>&lt;p&gt;Bob Carroll, a colleague in the Tampa Bay area, provides an interesting post on his blog regarding a &lt;a href="http://tampabay.injuryboard.com/medical-malpractice/doctor-must-ask-right-questions-even-if-the-patient-speaks-spanish.php"&gt;Florida case&lt;/a&gt; in which a non-english-speaking expectant mother may not have received the proper standard of care during the delivery of her son.  I agree with Bob when he says,&lt;/p&gt;&lt;p&gt;&lt;blockquote&gt;The standard of care provided to an expectant mother regarding delivery should not be lowered because she does not speak English. Nor should the expectant mother be expected to provide answers to questions that are not asked.&lt;/blockquote&gt;&lt;/p&gt;&lt;p&gt;This should apply in all states.
